Thank author of this post/commentI couldn't find the answer to my question on Illinois Dept. of Labor's website so I am hoping someone can help me. There are 5 employees at my job in Illinois (myself included) who are salaried and are being told we have to now go to hourly pay and will only be called in on an needed basis; not to exceed 20 hours per week and if we don't accept then they will take it that we resigned and we will not get unemployment benefits. For instance, I currently am salaried at $55, 000.00 annually; they want to change me to $16.00 an hour on an needed with some weeks being able to get just 20 hours a week. Do I have to accept this? This is more than a 50% cut in my pay and they are telling me if I don't accept it then I am resigning but I don't want to resign but I also can't afford to take a 50% cut in pay. I would make more on unemployment than I would taking that large of a cut in pay! Thank you for any information you can provide. Have a wonderful day. Sorry! To clarify, our owners stated there are some weeks we wont work at all and there are some weeks where we may work but we can not exceed 20 hours in the week we actually work. All of us that this is happening to would make more on unemployment even if we worked 20 hours but they are saying our only options are to resign or accept the 50% cut and that if we quit; none of us would be eligible for unemployment as then we quit as they were not terminating us. Is that fair to drop employee's salaries to less than they would make if getting unemployment? Can't we just tell them we don't accept and force them to terminate us?
