| Should we wait on H1B visa petition while married to a US citizen? I am an American Citizen enlisted in the military and is stationed in the Virginia. My fiance came as a tourist and is currently waiting on a H1B visa petition by his employer. We have planned to get married next month but we would not be living together and I chose not to change my last name either. Reason being, with the economic crisis, he doesn't not want to risk resigning from his job in California and moving to the East Coast with me since my enlistment would be done in 2years and I want to move back to CA closer to my family anyways. Are we better off staying with his H1B Visa Petition and wait off until I am back to CA permanently to adjust his status and apply for green card through marriage. How would it affect the process of his H1B visa petition and , just being realistic, what if the distance puts a strain in our marriage and falls apart even before i get to be permanently back in CA? How would that affect him in the future? |
